The American Civil Liberties Union is planning a legal challenge to a new law that takes effect Friday making it a crime in Tennessee to post any image online that causes “emotional distress” to any individual.
ACLU Tennessee Director Hedy Weinberg says her organization has received lots of inquiries for assistance and legal analysis. She says in a statement the new law creates a “chilling effect” on “political, artistic or otherwise lawful speech.”
The new state law does not provide criteria for what qualifies as offensive or disturbing. Weinburg says that leaves anyone with an online presence “vulnerable to prosecution.”
