Senator Lamar Alexander, a longtime critic of the National Labor Relations Board is ratcheting up his rhetoric. The Tennessean Republican says two members of the NLRB should resign immediately, after a court ruling found their appointment unconstitutional.
A federal court ruled last week that the president exceeded his authority when he appointed three members to the board, while Congress was in recess last year. One has already resigned, now Alexander says the remaining members need to go now.
“The two members of the NLRB should resign immediately, pack their bags, go home with our thanks for their hard work. Despite the fact that the 219 cases that they voted on ought to all be vacated.”
Alexander is the ranking Republican on the Senate committee in charge of labor policy. Since last week’s court ruling, he has been relentless in calling on the members to resign. He’s made multiple statements on the Senate floor and talked about the issue on Fox News. In an opinion piece for National Review, Alexander writes that President Obama’s actions were an overreach of the executive branch. However Alexander says he’s willing to consider new nominees the President might put forward, but the NLRB should stop its work until the Senate has a say in their appointment. Meanwhile, the Obama Administration is likely to appeal the ruling to the US Supreme Court.
