Last week’s run-off election determined who would fill four of Metro’s at-large council seats, but questions raised over three of the candidates’ term limited status continue a week later.
Candidate Saletta Holloway – a former council member who took nearly 28-thousand votes in the run-off – said (today/yesterday) she will likely contest the run-off election. In question would be the seat of at-large councilman-elect Charlie Tygard who ran after meeting his term limit as a district council member from Bellevue.
The same issue was challenged after the general election by candidate Philip Hostettler who didn’t make the run-off. He filed the challenge after the statute of limitations had expired, but a Davidson County judge also dismissed the case ruling that term limits apply only to each individual seat.
Holloway, though, still thinks there’s a case to be made. She sat out a term between her last stint in the Metro Council and says the spirit of the referendum that established term limits is to keep members from serving more than two consecutive terms in any seat.
“This is not about me. It’s about the fact that people want to do away with term limits and if somebody don’t do something then it sets a precedent which means that term limits will no longer be valid.”
Holloway says she has several attorneys working on the case but won’t yet name any firms. She says she will probably file her challenge before Friday – the same day the at-large council members are scheduled to be sworn in.
