Federal Judge Robert Echols will hear State Senator Rosalind Kurita’s challenge to the state’s election law next week.
Kurita filed a federal lawsuit last week claiming the Executive Committee of the state Democratic Party violated the 14th amendment when they removed her name from the ballot and replaced it with Tim Barnes. Kurita won the democratic primary by 19-votes over Barnes, but party officials voided her win over allegations of voting irregularities.
Kurita’s lawsuit asks that the state law regarding contested primaries be ruled unconstitutional. It also asks the judge to order Kurita be restored as the democratic nominee, or if the case isn’t decided in time, that the general election be voided, and a special election be held.
